Veteran Warriors Welcomes VA Decision to Rescind Medication-Based Disability Rating Rule

Today, the Department of Veterans Affairs (VA) rescinded its Interim Final Rule, Evaluative Rating: Impact of Medication, restoring the prior regulatory framework governing how disability evaluations are conducted.
The interim rule, published on February 17, 2026, would have required disability ratings to reflect how veterans function while using medication or treatment. Concerns were raised that this change could materially affect compensation outcomes for veterans managing chronic service-connected conditions.
Veteran Warriors welcomes the Department’s decision to withdraw the rule.
Preserving Statutory and Judicial Integrity
Disability compensation is governed by statute and informed by longstanding judicial interpretation. When regulatory changes affect how functional impairment is measured, it is essential that those changes:
Remain firmly grounded in statutory authority
Align with applicable case law
Be implemented through transparent and deliberate rulemaking processes
Compensation determinations directly affect the financial stability and long-term planning of veterans and their families. Stability and predictability within the rating system are critical to maintaining trust in the benefits structure Congress has authorized.

Disability compensation is designed to account for the real-world impact of service-connected conditions, including those requiring ongoing treatment.
When evaluation standards are modified, even interpretively, the effects can extend across pending claims and existing ratings. Stability and predictability in compensation policy are therefore essential.

Veteran Warriors Reviewing VA Interim Final Rule on Impact of Medication in Disability Ratings; Raises Significant Concerns
Washington, D.C. — Veteran Warriors is in the process of preparing a formal public comment regarding the Department of Veterans Affairs’ interim final rule amending 38 C.F.R. § 4.10, titled “Evaluative Rating: Impact of Medication,” published February 17, 2026. The organization has significant concerns about the rule’s potential impact on disability evaluations for veterans nationwide.
The interim final rule clarifies that VA disability ratings will reflect a veteran’s level of functioning as observed at examination, including the ameliorative effects of medication. While characterized as a clarification of existing policy, the rule may substantially influence how hundreds of diagnostic codes are applied and how functional impairment is measured.
Veteran Warriors is particularly concerned that evaluating disabilities primarily on medicated presentation risks understating the true severity of service-connected conditions and their long-term occupational impact.
“Medication may suppress symptoms, but it does not eliminate the underlying condition or injury,” Veteran Warriors stated. “Many veterans rely on continuous pharmaceutical treatment simply to maintain minimal stability. That reality does not equate to restored earning capacity.”
Veterans managing chronic physical and mental health conditions frequently experience:
Significant medication side effects affecting cognition, stamina, or emotional regulation
Breakthrough symptoms despite compliance
Functional fragility if medication is interrupted
Lifelong dependence on structured treatment regimens
The VA disability compensation system exists to compensate for average impairment in earning capacity under 38 U.S.C. § 1155. Longstanding legal precedent further establishes that the veterans’ benefits framework is uniquely pro-claimant and that interpretive doubt must be resolved in favor of the veteran. Judicial decisions such as Brown v. Gardner (1994), Jones v. Shinseki (2012), and Ingram v. Collins (2025) emphasize that disability evaluations must accurately reflect true functional impairment and must not narrowly construe ambiguity against claimants.
Veteran Warriors is carefully reviewing the rule’s language, its legal foundation, and its potential consequences for veterans who responsibly comply with prescribed treatment. The organization intends to advocate for safeguards ensuring that disability ratings fully account for underlying severity, occupational limitations, and the benefit-of-the-doubt doctrine codified at 38 U.S.C. § 5107(b).
The public comment period remains open through April 20, 2026.
